TERMS & CONDITIONS

1) Introduction
1.1 These Terms and Conditions govern all auctions conducted by Albion Antique Auction Centre, hereafter referred to as "AAAC"
1.2 By registering, bidding, or participating in any auction facilitated by AAAC or Invaluable.com, the Buyer and vendor agree to be bound by the following conditions.
1.3 AAAC operates under the direction of the principal, Cameroon Trindall, and conducts all business in accordance with applicable Queensland legislation.
1.4. Force Majeure
AAAC shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to fire, flood, power failure, natural disaster, strike, government action, or failure of third-party platforms or utilities.
2) Agency & Principal
2.1 AAAC acts as agent for the vendor unless otherwise stated.
2.2 The principal of AAAC is Cameroon Trindall, who retains full authority over all auction operations, consignment decisions, reserves, and administrative approvals.
2.3 AAAC may refuse or withdraw goods at its discretion.
3) Bidding
3.1. All bidders must register prior to bidding and must link a valid credit card for verification.
3.2 AAAC, acting through the Auctioneer or the Principal, reserves the absolute right, at its sole discretion and without obligation to provide reasons, to refuse bidder registration, reject or cancel any bid, suspend or terminate bidding privileges, or remove any bidder from an auction at any stage.
3.3. Reserves are start prices at AAAC.
3.4. The auctioneer's decision is final in all disputes, including competing bids or disputes as to the last bid taken. They may also "ask change" a lot or re-auction lots at their discretion.
3.5. Bidders participate at their own risk, including online bidders who accept responsibility for potential connectivity issues, delays, or technical failures.
3.6. Vendor Bidding Prohibited: Vendors are strictly prohibited from bidding on their own lots. Any vendor found doing so will be permanently banned and may also be banned on partner platforms. vendors may be liable for any losses, costs, or enforcement action arising from bidding on their own lots.
3.7 Bidding "On the Wrong Foot"
"Bidding on the wrong foot" occurs when two or more bidders have entered the same maximum bid amount. Where matching maximum bids are placed, the bidder who first entered that maximum bid will hold the current leading bid.
A later bidder who enters the same maximum bid will not displace the earlier bid and may be shown at the preceding increment, despite having the same maximum amount recorded. That later bidder is deemed to be "on the wrong foot", meaning they do not hold the standing bid due to the time priority of bids.
A bidder on the wrong foot must increase their bid above the shared maximum amount in order to regain the lead.
A bidder on the wrong foot must increase their bid beyond the shared maximum if they wish to regain the lead.
3.8 Competing Bids
A competing bid is any valid bid placed by another bidder that challenges or exceeds the current leading bid. Competing bids may be placed in person, online, absentee, or by online absentee bid, and are recognized once accepted by the auctioneer or the auction system.
A competing bid becomes active when it surpasses the current standing bid in accordance with the prescribed bidding increments. When a competing bid is received, the previous high bidder is no longer in the lead and must place a higher bid to continue participating.
Example:
If bidder "A" is the current high bidder at $80 and bidder "B" places a bid of $85 (in line with the required increment), bidder B's bid becomes the competing bid and is now the leading bid. bidder A must then bid $90 or more if they wish to regain the lead.
3.9 Telephone & Absentee Bidding
Telephone and absentee bidding are provided as a courtesy only and are subject to availability and staff capacity.
AAAC accepts no responsibility or liability for any error, omission, failure, or inability to execute a telephone bid or absentee bid for any reason whatsoever, including but not limited to communication failures, staff error, internet or system issues, or time constraints.
Telephone bids will only be accepted for items with a minimum estimated value or bidding level of $100 per item. Buyers must not telephone AAAC during the auction in relation to absentee bids, bid confirmations, or bidding enquiries.
No telephone bids or absentee bids will be accepted after 8:30am on the day of the auction. Any bids received after this time will not be processed.

4) Buyer's Premium
A buyer's premium of 22% (GST inclusive) applies to all lots sold at auction.
Example: A hammer price of $100 results in a total of $122 payable before additional charges such as postage or third-party fees.
5) Export / Import Restrictions
5.1 Buyers must ensure that all purchased goods comply with all applicable export, import, quarantine, and cultural heritage laws, including the laws and regulations of the Buyer's own country, state, or local jurisdiction
5.2. AAAC does not complete or prepare export documentation.
5.3. All export compliance, permits, declarations, or certificates must be arranged by the buyer or their export agent.
5.4. International buyers are responsible for all duties, taxes, or border charges imposed by their jurisdiction.
6) Payment
6.1. Payment must be made within three ( 3) business days of the Auction date unless otherwise arranged with the Principal or the Principal's authorized agent.
6.2. Accepted payment methods:
• Bank transfer (EFT)
• Visa and Mastercard (American Express not accepted)
• Over?the?phone card payments ( Domestic Only)
• All invoices must be paid in Australian Dollar (AUD)
6.3. Goods will not be released until all funds have cleared.
6.4. International buyers are required to provide:
• Identification and proof of address
• AAAC's International Credit Card Authorization Form (Click here)
This form exists to prevent fraudulent chargebacks. Any chargeback action may result in the buyer incurring recovery fees, administrative fees, and legal costs.
6.5. International Buyers are responsible for all duties, tariffs, brokerage fees, and customs inspections.
6.6. Failure to collect goods does not void the buyer`s obligation to pay.
7) Online Bidding
7.1. AAAC is not responsible for internet issues, platform outages, or missed bids. AAAC accepts no responsibility for loss of opportunity, financial loss, or consequential damages arising from such issues.
7.2. AAAC's records and the Invaluable bid log are conclusive and final.
8) Buyer's Obligations Post?Sale
8.1. Buyers must pay within three (3) days and collect within seven (7) days
8.2. Buyers must not remove or interfere with any goods until full payment has been made.
8.3. All storage fees must be paid before goods are released. (see section 11.2 for fees)
8.4 Risk in purchased goods passes to the buyer at the fall of the hammer, notwithstanding that the goods remain on AAAC premises.



9) Local Pickup
9.1 Pickup times vary depending on the type of auction conducted. for collectables and jewellery auctions, collection may commence one (1) hour after the auction has concluded.
9.2 For furniture and art auctions, pickup begins on Friday at 9:00 am, and no booking is required.
9.3 Purchased lots may also be collected Monday to Thursday between 9:00 am and 4:00 pm, and Friday between 9:00 am and 3:00 pm. No Booking required.
9.4 Tables are available for buyers to pack their own items. AAAC may have limited packing materials available; however, availability cannot be guaranteed, and buyers should not rely on AAAC to provide boxes, wrapping, or protective materials.
9.5 Buyers are solely responsible for the safe packing, lifting, loading, and removal of all purchased items. AAAC staff are not obliged to assist with carrying or loading goods. Buyers must bring sufficient labour, equipment, and appropriate vehicles to remove their purchases safely.
Where an item is estimated by AAAC to weigh twenty kilograms (20kg) or more, AAAC staff will not move, lift, or handle the item under any circumstances. AAAC accepts no liability for damage or injury occurring during the removal of goods from the premises.

9.6 No transfers: no lot may be transferred, assigned, or otherwise allocated to any person other than the winning bidder prior to its removal from Albion Antique Auction Centre. Only the winning bidder, or an authorised agent appointed by the winning bidder, is permitted to collect or remove the purchased lot from AAAC's premises.
9.7 Risk of loss: In the event that delivery cannot be made due to loss, damage, destruction, or unavailability of the lot arising from fire, theft, or any other cause, Albion Antique Auction Centre's liability shall be strictly limited to the return of any deposits or payments made by the purchaser for that lot. No further compensation, damages, or consequential claims shall be payable by AAAC.
9.8 Vendor restrictions on removal of purchased lots: Vendors are not permitted to remove their purchased lots from the shelves or premises themselves. All removal of purchased lots must be carried out by AAAC staff or under AAAC's direction to ensure accurate recording and proper handling of auction goods.

10) Australia Post Shipping
• Request a shipping quote first to determine if shipping is viable.
AAAC will issue a shipping invoice & CC in accounts. Once payment is received, Australia Post dispatch will occur, and a tracking number will be emailed to the buyer.
10.1. AAAC provides limited in?house shipping through Australia Post for suitable items, depending on several factors, inc. but not limited to: weight, size, fragility, and if the item is dangerous.
10.2. Australia Post shipments arranged by AAAC are uninsured unless the buyer independently purchases insurance.
10.3. Australia Post quotes are calculated case?by?case based on size, weight, fragility, destination, and current carrier pricing, as well as packing and handling.
10.4. Once an item has been dispatched and a tracking number has been issued to the buyer, AAAC bears no further responsibility. All responsibility transfers to Australia Post & the customer
10.5.Once goods have been dispatched, any delivery issues, delays, loss, or damage should be raised directly with Australia Post, as AAAC is not the carrier and is not responsible for the investigation or resolution of shipping claims
10.6. In?House Postage Procedure:

10.7. Buyers have 1 week from the invoice date to request shipping. After this period, storage fees of $5 per lot per day will apply.
11) International Shipping
• Request a shipping quote first to determine if shipping is viable.
AAAC will issue a shipping invoice & CC in accounts. Once payment is received, Australia Post dispatch will occur, and a tracking number will be emailed to the buyer.
11.1. International buyers are responsible for all duties, taxes, customs fees, inspections, delays, and import restrictions.
11.2. AAAC does not provide declarations, estimates, or additional documentation for import processes.
11.3. Once dispatched internationally via Australia Post, all risk transfers to the carrier. AAAC is not responsible for customs holds, loss, damage, or return?to?sender events.
11.4. No in-house shipping is available to the U.S.A. without prior purchase approval.
12) Third?Party Shipping
12.1. For fragile, oversized, or high?value items, where appropriate, AAAC may provide buyers with contact details for independent third-party carriers as a courtesy only.
Such recommendations are provided without endorsement or Commission, and AAAC does not act as agent for, or accept any responsibility for, the services provided by these carriers.
All arrangements, pricing, insurance, handling, risk of loss, and liability remain solely between the buyer and the carrier.

AAAC accepts no liability for any loss, damage, delay, costs, or personal injury arising from the use of any third-party carrier.
12.2. All packing, handling, insurance, and delivery arrangements with third-party providers are solely between the buyer and the freight company.
12.3. AAAC accepts no liability for damage, loss, delays, costs or errors caused by third?party carriers.
13) Failure to Pay or Collect
13.1. If the buyer fails to pay, AAAC may cancel the sale, re-offer the lot, or pursue recovery action. Any resale may be conducted at the discretion of AAAC, and any shortfall, fees, storage, or associated costs may be recovered from the defaulting buyer as a debt due.
13.2. If the buyer fails to collect goods after one week, storage fees apply at a rate of $5 per lot per day.
13.3. After 6 months, uncollected goods may be treated in accordance with the "Disposal of Uncollected Goods Act 1967 (Qld"). The buyer may still be liable for storage fees.
13.4. If property is not collected within one (1) month of the auction date, Albion Antique Auction Centre reserves the right to suspend or decline the buyer's registration for any future auctions until the matter is resolved to the satisfaction of AAAC. Continued failure to collect property may result in the buyer being permanently refused approval to bid in subsequent auctions.
14) Condition & Inspection
14.1. All lots are sold "as is." Descriptions are opinions only.
14.2 Photographs are provided for identification and illustrative purposes only and do not form part of the description or condition report. Variations in colour, scale, clarity, and detail may occur.
14.3. Inspection is available on Wednesdays or by appointment. AAAC encourages all prospective buyers to inspect all items before bidding, where practicable
14.4. AAAC does not guarantee authenticity unless expressly stated in writing.
14.5. Buyers rely on their own inspection and judgment.
14.6. Condition reports. All condition report requests must be submitted via email only. Albion Antique Auction Centre does not provide condition reports by phone or in person. Condition reports will be supplied at AAAC's discretion and in the order in which requests are received.
14.7. Stickers, Labels and Surface Finishes
Some lots may bear adhesive stickers or labels applied for identification or inventory purposes. Removal of these stickers may, in some cases, result in damage to surface finishes, including but not limited to paint, lacquer, gilding, polish, veneer, or patination.
Buyers are advised to lightly moisten the sticker and remove it slowly and carefully to reduce the risk of damage. Albion Antique Auction Centre accepts no responsibility for damage caused by the removal of stickers or labels, whether undertaken by the buyer or a third party.
14.8. Buyers are solely responsible for determining the suitability of any item for their intended purpose. AAAC makes no representation as to fitness for purpose.
14.9 The absence of any reference to a fault, defect, restoration, damage, or condition issue does not imply that the item is free from defects or in perfect condition. Buyers must rely on their own inspection and judgment prior to bidding.
15) Jewellery, Gemstones and Watches
15.1 Gemstone Weights and Treatments
All gemstone weights stated by AAAC are approximate. Gemstones may be subject to a wide range of treatments and enhancements, including but not limited to heat, diffusion, irradiation, HTHP, oiling, resin filling, bleaching, dyeing, and impregnation. Some treatments are permanent, while others may be temporary or unstable over time. Multiple treatments may be applied to a single gemstone.
Not all treatments are detectable using standard gemmological equipment, and AAAC makes no representation or warranty that all treatments have been identified.
15.2 Laboratory Reports
Any laboratory report provided with a lot reflects the professional opinion of that laboratory on the specific date of examination only. AAAC does not guarantee the accuracy, completeness, or continued validity of any laboratory findings or opinions. Buyers are encouraged to obtain independent assessments where necessary.
15.3 Watches - Operation and Authenticity
Descriptions of watches relate solely to their apparent function at the time of cataloguing. AAAC does not guarantee the accuracy, timekeeping, continued operation, or future performance of any watch.
Further, AAAC does not guarantee the authenticity or originality of individual components, including but not limited to dials, hands, movements, crowns, crystals, or bracelets, which may have been replaced, repaired, restored, or altered at any time prior to consignment.

16) Safety & Access
16.1. Entry to AAAC premises is at the visitor's own risk.
16.2. The premises are monitored by 24/7 CCTV.
16.3. AAAC may refuse entry or direct removal of any person at its discretion.
16.4 No video recording, filming, photography, livestreaming, or use of recording devices is permitted on AAAC premises without the prior express consent of the Principal.
17) Consignment
17.1. Consigned items are accepted under AAAC's consignment conditions.
17.2. Re-consignment of goods is available at AAAC's discretion.
17.3. Once a consigned item has been published online, it cannot be withdrawn. If withdrawn before the time of publication, a $50 AUD administration fee will apply.
17.4. Reserves: No reserves will be accepted unless discussed on the day of consignment and expressly approved by the principal or an authorized agent. Reserves are start prices.
17.5 Cancelled Sales - Shipping Liability: If a sale is cancelled for any reason, Albion Antique Auction Centre will not be responsible for any shipping or return-shipping charges incurred. All such costs remain the sole responsibility of the purchaser or consignor, as applicable.

18) Privacy
18.1. AAAC complies with the "Privacy Act 1988 (Cth)"
18.2. Personal information is used for bidding, payment, communication, and legal compliance only.
18.3. AAAC may share information with partner platforms such as Invaluable for compliance or enforcement.
18.4. All catalogue descriptions, photographs, condition reports, and written material remain the intellectual property of AAAC and may not be reproduced without prior written consent.
19) Governing Law
19.1 These Terms and Conditions are governed by the laws of Queensland, Australia, including the Motor Dealers and Chattel Auctioneers Act 2014 (Qld) and any regulations made under that Act.
19.2 Albion Antique Auction Centre is operated by AAAC Pty Ltd, Licensed Auctioneer under the Motor Dealers and Chattel Auctioneers Act 2014 (Qld) (Licence No. 3559204).
19.3 The Principal, Cameroon Philip Trindall, holds an individual auctioneer's licence under the same Act (Licence No. 2607163).
19.4. Disputes are subject to the jurisdiction of the Queensland Courts.
19.5. AAAC complies with the Queensland Office of Fair Trading requirements.

Natural - Formed in nature, may be treated.
Synthetic - Lab?created but chemically identical.
Simulated / Copy - Imitation, not chemically identical.
Appearance?Only Terms:
Gold?Tone - Gold?coloured; contains no gold.
Silver?Tone - Silver?coloured; contains no silver.

Marking Notation:
Quotation Marks " " - Indicates the exact hallmark physically stamped on the item.

Credit Card Payment

All payments settled by credit card will not incurr any additional fees or charges.

Shipping Terms

Auction House will help arrange shipment of small portable items, at buyer's expense, they are sent via Australia Post, and are sent uninsured, large quantities, odd sizes and more delicate items, or your wanting a fully insured service we are unable to help buyers, we do recommend Albion Pack and Send for these items
